1. General agreement / Conclusion of a distance contract 

1.1 AUTO PARTS POWERHOUSE, provides content available at www.autopartspowerhouse.com, hereinafter – the Website, and sells goods in accordance with the terms and conditions set out below, as well as delivery terms, return policy and other terms and conditions and operational policies that can be found on the Website, collectively – the Terms and Conditions. By making a purchase on the Website, the customer confirms that he/she has read, understands and agrees to comply with the Terms and Conditions without any restrictions or conditions. 

1.2 If the customer, as a consumer, purchases the goods offered on the AUTO PARTS POWERHOUSE Website via the Internet, such mutual agreement shall be deemed to be a distance contract under the Consumer Rights Protection Law, Regulation No 255 “Regulations Regarding Distance Contracts” of the Cabinet of Ministers of the Republic of Latvia and related legislation.

1.3 If the customer who has ordered and purchased goods on the Website has no legal capacity or capacity to act, a legal representative (parent or guardian) of such person shall be responsible for the order and payment for the goods. In such case, the order cannot be cancelled and the payment is non-refundable.

1.4 When registering on the Website, the customer creates his/her account through which he/she can conclude a Distance Contract. A Distance Contract for the purchase of goods shall be deemed to be concluded as of the time of payment for the goods.

3. Purpose of the website

The Website was created and is maintained by AUTO PARTS POWERHOUSE. The website has been designed to allow customers to familiarize themselves with the goods sold by AUTO PARTS POWERHOUSE and ensure their purchase, as well as to ensure effective communication with AUTO PARTS POWERHOUSE regarding the selection and purchase of goods offered on the Website.

4. Intellectual property rights

4.1 All content made available on the Website, including but not limited to text, graphics, layout, databases, design elements, trademarks, logos, product images, audio, video, and other materials (the “Content”), is protected by applicable European Union, EEA, and national intellectual property laws and is either owned by AUTO PARTS POWERHOUSE or used lawfully under license, permission, statutory limitation, or other legitimate rights.

All third-party trademarks, logos, brand names, and original part numbers displayed on the Website remain the exclusive property of their respective rights holders and are used strictly for informational and descriptive purposes, in particular to identify vehicle models, determine spare part compatibility, and support lawful vehicle repair or restoration, without implying any affiliation, endorsement, or commercial connection between AUTO PARTS POWERHOUSE and the respective manufacturers.

4.2 Certain products offered on the Website may be subject to registered design protection or design copyright held by original vehicle manufacturers or other rights holders; where applicable, such products are offered and may be used exclusively for the purpose of repairing a vehicle in order to restore its original appearance, in accordance with applicable European Union, EEA, and national laws, and are not intended for modification, customization, enhancement, or any other use beyond such repair.

4.3 Any copying, reproduction, republication, distribution, modification, extraction, or other use of the Website or its Content, in whole or in part, without prior written permission from AUTO PARTS POWERHOUSE or the relevant rights holder is strictly prohibited.

5. Goods

5.1 The AUTO PARTS POWERHOUSE Website offers spare parts, accumulators, car accessories, electronics and tools for passenger cars and light commercial vehicles, hereinafter – the Goods.

5.2 AUTO PARTS POWERHOUSE provides true and extensive information regarding the technical specifications of the Goods, and, to the extent possible, information about car models which the Goods are suitable for. If you are unsure if certain Goods are suitable for particular car models, please contact AUTO PARTS POWERHOUSE before placing an order.

5.3 AUTO PARTS POWERHOUSE Website provides maximally accurate information regarding the available products, but AUTO PARTS POWERHOUSE cannot guarantee that the information regarding the Goods is fully representative of the products. 

5.4 All Goods purchased on the Website are covered by the manufacturer’s warranty which is separately laid out for each one of the Goods, i.e. the guarantor, warranty term, amount and conditions. Regardless of the manufacturer’s warranty, the customer, as a consumer, has a statutory right to submit a claim regarding Goods that do not comply with the Terms and Conditions within 24 (twenty-four) months from the date of delivery of the Goods.

5.5 To exercise the warranty right, the consumer fills out the return form attached to each purchase and together with the Goods delivers it to the AUTO PARTS POWERHOUSE office at USA and Australia. AUTO PARTS POWERHOUSE sends the Goods to the manufacturer without delay to establish a warranty case, if possible. If the manufacturer of the Goods confirms the non-compliance of the Goods with the quality standards, AUTO PARTS POWERHOUSE will refund you for the purchased Goods. If the manufacturer of the Goods does not approve the non-compliance of the Goods with the quality standards, we will provide you with a motivated explanation of the reasons.

5.6 Certain products offered on the Website qualify as electrical and electronic equipment (EEE) within the meaning of Directive 2012/19/EU on waste electrical and electronic equipment (WEEE), as implemented under applicable European Union, EEA, and national laws.

Such products must not be disposed of together with unsorted municipal waste and are subject to separate collection and environmentally sound treatment, recovery, and recycling, as indicated by the crossed-out wheeled bin symbol.

End users are responsible for returning waste electrical and electronic equipment to appropriate collection facilities in accordance with applicable local regulations.

Where required by law, AUTO PARTS POWERHOUSE fulfils its obligations as a producer or distributor of EEE in the relevant jurisdictions, including registration, reporting, and financing of WEEE management, either directly or through authorised compliance schemes.

6. Additional services

AUTO PARTS POWERHOUSE offers certain additional services that may be selected by the customer during the checkout process. These services are optional and are provided in accordance with the terms set out below.

6.1 Product Compatibility Verification

Product Compatibility Verification is an optional service provided by AUTO PARTS POWERHOUSE, and is available in both free and paid versions. The service consists of a comparison of manufacturer and/or Original Equipment (OE) specifications against the vehicle identification number (VIN) submitted by the customer.

6.1.1 To enable the service, the customer must provide a complete and accurate VIN corresponding to the vehicle for which the products are intended. The customer remains solely responsible for ensuring that all information provided is correct and complete.

6.1.2 Regardless of the outcome of the Compatibility Verification, the customer remains responsible for inspecting the delivered products upon receipt and comparing them with the parts installed on their vehicle before installation. Failure to perform such inspection prior to installation or use may result in the loss of return rights in accordance with our Returns and Refunds policy.

6.1.3 Compatibility Verification is performed based on the data available to AUTO PARTS POWERHOUSE at the time of verification, including OE databases and manufacturer information. AUTO PARTS POWERHOUSE shall not be liable for incorrect verification results arising from:

  • inaccurate, incomplete, or incorrect VIN or vehicle information provided by the customer;
  • errors, omissions, or inaccuracies in OE or manufacturer data sources beyond our control.

6.1.4 The Compatibility Verification fee (applicable to the high-priority service only) is non-refundable, including in cases where the order is returned in full or in part, the customer disputes the verification results, or the order is canceled, unless otherwise required by mandatory law.

6.2 Flexi Order

6.2.1 Flexi Order provides the customer with high-priority Compatibility Verification (where applicable), priority order processing, and an extended return period of 365 days – subject to the conditions set out in the Returns and Refunds policy. Priority handling does not constitute a guaranteed delivery time.

6.2.2 The Flexi Order service fee is non-refundable, including in cases where the order is returned in full or in part, the customer does not make use of one or more of the included benefits, the order is canceled after processing has begun.

6.3 Prepaid Import Fees

6.3.1 For deliveries outside the European Union, AUTO PARTS POWERHOUSE may offer an optional prepaid Import Fees service at checkout. Where selected, estimated import duties, taxes, and related fees are calculated based on the products in the customer’s cart, the delivery address, and applicable local laws and charges, and are collected in advance so that no payment is required upon delivery.

6.3.2 The prepaid Import Fees amount is an estimate only. If the actual import fees assessed at delivery exceed the estimated amount, AUTO PARTS POWERHOUSE will pay the difference. If the actual fees are lower than the estimated amount, the customer is not entitled to a refund of the difference.

6.3.3 Prepaid Import Fees are non-refundable once order processing has begun, including in cases of order cancelation, return, refusal of delivery, or failed delivery, unless otherwise required by mandatory law. Customs clearance decisions remain the responsibility of the relevant authorities.

7. Pricing policy

7.1 All prices on the Website are indicated in EUR. All prices include VAT or other taxes and fees, if applicable. Depending on the chosen type of delivery, order amount and delivery address, AUTO PARTS POWERHOUSE may apply a delivery charge to the order which will be clearly indicated before the payment is approved and will be included in the total order cost.

7.2 AUTO PARTS POWERHOUSE will indicate the total price of the Goods, including all taxes and fees, as well as delivery or postal charges, prior to the conclusion of the Distance Contract. If AUTO PARTS POWERHOUSE is unable to calculate the delivery or postal charges in advance, AUTO PARTS POWERHOUSE will inform the customer about it.

7.3 If AUTO PARTS POWERHOUSE finds that the order price differs from the price indicated on the Website at the time of placing an order, AUTO PARTS POWERHOUSE will contact the customer and will offer to cancel the order. If AUTO PARTS POWERHOUSE fails to contact the customer, the order will be deemed to be cancelled and AUTO PARTS POWERHOUSE will refund the customer for all payments made with respect to the particular order.

8. Payment

9. Terms of delivery

9.1 Information regarding the types, procedures and costs for order receipt and delivery is available on the Terms of Delivery section on the Website. Information regarding the availability of Goods, as well as the receipt and delivery times, is available at each product description.

9.2 By placing an order, the customer agrees that AUTO PARTS POWERHOUSE prepares the invoice electronically and it is valid without signature. AUTO PARTS POWERHOUSE can provide a delivery note in printed form, if the customer notifies it in advance by sending an e-mail to: contact@autopartspowerhouse.com

9.3 We strive to provide accurate delivery estimates at the time of purchase. However, kindly note that the delivery dates displayed at checkout are estimates based on typical order processing and shipping times. These are intended as a guideline rather than a guarantee of delivery date. By placing an order with us, you acknowledge and consent to the possibility that the delivery date may deviate from the anticipated schedule.

10. Right of withdrawal

10.1 The Customer shall have the right to withdraw from the Distance Contract within 30 (thirty) days from receipt of the Goods without providing any reason. In order for the right of withdrawal to be respected, the notice to exercise the right of withdrawal shall be sent before the term for the right of withdrawal expires.

10.2 In order to exercise the right of withdrawal, the customer must inform AUTO PARTS POWERHOUSE of the decision to withdraw from the Distance Agreement by a clearly worded statement. Notice of the exercise of the right of withdrawal can be sent electronically to: contact@autopartspowerhouse.com. In order to communicate the exercise of the right of withdrawal, the customer may use the model withdrawal form attached to each order.

10.3 Upon notification of the exercise of the right of withdrawal, the customer shall immediately and in any event not later than within 14 (fourteen) days from the date the customer has notified AUTO PARTS POWERHOUSE of his/her decision to withdraw from the Distance Contract, return the Goods to the AUTO PARTS POWERHOUSE office in Australia or USA during AUTO PARTS POWERHOUSE office hours or send it by post to AUTO PARTS POWERHOUSE . To agree on another way for returning the Goods, please contact AUTO PARTS POWERHOUSE. The deadline will be deemed to be met if the Goods are returned before the expiration of the 30-day period.

10.4 If the customer withdraws from the Distance Contract, AUTO PARTS POWERHOUSE will reimburse all payments received from the customer, including delivery charges (excluding any additional charges incurred by the customer in choosing a delivery method other than AUTO PARTS POWERHOUSE cheapest standard delivery method) without undue delay and in any event no later than 14 (fourteen) days from the date the customer has informed AUTO PARTS POWERHOUSE of the decision to withdraw from the Distance Agreement. AUTO PARTS POWERHOUSE will refund the money using the same means of payment the customer used to complete the transaction, unless the customer has requested otherwise. In any case, AUTO PARTS POWERHOUSE will not charge any additional fees for the refund. AUTO PARTS POWERHOUSE may withhold the refund until AUTO PARTS POWERHOUSE has received the returned Goods.

10.5 The customer is liable for any diminished value of the Goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the Goods. In the event that AUTO PARTS POWERHOUSE should find that the Goods have been used, are damaged, dirty, otherwise exploited or contain indications of assembly or use, AUTO PARTS POWERHOUSE may refuse to accept the returned Goods. The Goods must be placed in their original packaging that is not damaged or smudged.

11. Indemnity

11.1 The customer undertakes to indemnify, defend and protect AUTO PARTS POWERHOUSE from any harm, losses, damages or costs as well as attorney fees resulting from any claim, case or action brought by a third party for violation of the Terms and Conditions, any errors in any of the customer’s representations or warranties or customer’s use of the Website.

12. Dispute resolution

12.1 Any disputes regarding the customer’s authorisation on the Website or arising from the execution, interpretation or termination of the Distance Contract shall be settled through mutual negotiations.

12.2 Within the time limits and the form laid out in the laws and regulations, AUTO PARTS POWERHOUSE will respond to any applications submitted by the customer and will inform the customer about the possible ways to enforce the particular claim or solve the particular dispute, or about any alternative ways to enforce the particular claim.

12.3 If the dispute cannot be resolved through peaceful mutual negotiations, the customer, as a consumer, may bring an action before the courts of the Republic of Latvia, which is AUTO PARTS POWERHOUSE country of establishment, or before the courts of the country in which the customer resides (domiciles) as a consumer.

AUTO PARTS POWERHOUSE can bring an action against the customer as a consumer only before the courts of the Member State in which the customer resides (domiciles) as a consumer.

12.4 With these Terms and Conditions AUTO PARTS POWERHOUSE does not in any way limit the customer’s right to turn to the Consumer Rights Protection Centre for the protection of his/her consumer rights.

13. General provisions

13.1 The customer agrees that these Terms and Conditions constitute the entire and up to date agreement between the customer and AUTO PARTS POWERHOUSE regarding the use of this Website and its contents.

13.2 AUTO PARTS POWERHOUSE has the right to update and edit the Terms and Conditions at any time by posting the relevant changes on the Website and indicating any such change by posting a date of the latest update. Any changes made to the Terms and Conditions shall come into effect immediately after their publication. The customer agrees that by continuing to use the Website after such changes have been made, he/she consents to all and any changes. AUTO PARTS POWERHOUSE reserves the right to terminate or revoke any rights granted by these Terms and Conditions. The customer must comply with such revocation or changes from the moment of their implementation, including, if required, by terminating the use of the Website in any way.

13.3 No part of these Terms and Conditions shall be interpreted as establishing a partnership or any other type of joint venture between the customer and AUTO PARTS POWERHOUSE . In the event that AUTO PARTS POWERHOUSE fails to ensure customer’s compliance with the Terms and Conditions, such noncompliance shall not affect AUTO PARTS POWERHOUSE right to claim compliance thereafter. In the event where any provision of these Terms and Conditions is unenforceable or invalid under the applicable law or is ruled to be unenforceable or invalid by a decision of the competent authority or court, it shall not render these Terms and Conditions invalid or inapplicable as a whole. In turn, the Terms and Conditions shall be modified, to the extent possible, according to the applicable law in order to fully reflect the original intention under the original Terms and Conditions.
